Alabama DUI Penalties

In addition to the penalties listed below, all persons convicted of the crime of Driving Under the Influence are required to post high risk SR-22 insurance and attend and complete a DUI or substance abuse program. Also, the enhanced penalties are imposed on convictions received within a five year period, except for the third and subsequent convictions which are measured over a person's lifetime.

First Offense (Misdemeanor)
Jail Time: County or City Jail not more than 1 year, and/or
Fine: $600 to $2100
DL Suspension: Ninety (90) days
DUI School - Level 1, 2 or 3

Second Offense: (within a five year period) (Misdemeanor)

Jail Time: County or City Jail not more than 1 year, and/or (Mandatory 5 days jail time or not less than 30 days community service)
Fine: $1100 to $5100
DL Suspension: One (1) year
DUI School - Level 1, 2 or 3

Third Offense: (anytime within a person's life) (Misdemeanor)

Jail Time: County or City Jail not more than 1 year, and (Mandatory jail time of 60 days)
Fine: $2100 to $10100
DL Suspension: Three (3) years
DUI School - Level 1, 2 or 3

Fourth Offense: (anytime within a person's life - Felony)

Jail Time: County Jail or State Prison not less than 1 year and 1 day nor more than 10 years, and
Fine: $4100 to $10100
DL Suspension: Five (5) years

DUI School - Level 1, 2 or 3
